33-302.109 Offender Orientation.
(1) Correctional probation officers shall meet with an offender within two working days of offender assignment or the onset of
supervision to provide orientation to the offender as to the conditions of supervisio4 and instructions regarding supervision.
Orientation shall be in a language understood by the offender and accommodations shall be made in the even~an offender has a~
documented disability or language barrier.
(2) Offenders shall be provided an opportunity to ask questions or request clarification of any or all of the conditions of his or
her supervision.
(a) After acknowledging an understanding of the conditions of supervision, the offender shall sign and date the orders of
supervision.
(b) The offender shall be provided '~Srith a copy of the orders of supervision.
(3) The correctional probation officer shall instruct on and review the information contained in the Notice of Privacy Practices,
Form DC3-2006. Form DC3-2006 is hereby incorporated by reference. Copies of this form are available from the Forms Control
Administrator, Office of Research, Planning and Support Services, 2601 Blair Stone Road, Tallahassee, Florida 32399-2500. The
effective date of this form is July 30, 2003. The correctional probation officer and the offender shall sign and date Form DC3-2006,
Notice of Privacy Practices, certif~'ing that the offender has received a copy of the privacy notice. The current telephone number
of
the department's privacy officer will be inserted at this time. The original executed Form DC3-2006 shall be placed in the offender
file and a copy shall be provided to the offender.

Dear Sheriff Campbell,
This is to confirm that my firm is in receipt of the four public records request that you faxed to my office on Tuesday, September 16, 2008.
At this time I am writing to inform you that Florida Statutes Chapter 119, entitled Public Records, is a statutory function to create open governmental agencies within the State of Florida. It appears from the reading of Florida Statute 119.01(1) that it was the intent of the Florida Legislature that all state, county, and municipal records be open for personal inspection and copying by any person of the public desiring to do so. All agencies have a duty to provide the public who so desires to inspect public records with the access to do so.
As I stated above having received your record requests from my office for copies of billings for indigent clients I was appointed to in the past I feel the need to formally inform you in writing that I am not a governmental agency Sheriff Campbell. I own and have owned my own law practice which your faxing your requests to is proof you are aware of that fact.
Florida Statutes Section 119.011(2) defines an agency as: "Agency" means any state, county, district, authority, or municipal officer, department, division, board, bureau, commission, or other separate unit of government created or established by law including, for the purposes of this chapter, the Commission on Ethics, the Public Service Commission, and the Office of Public Counsel, and any other public or private agency, person, partnership, corporation, or business entity acting on behalf of any public agency.
As you read the above definition Sheriff Campbell, I hope you would agree with me that under both the definition of "agency" in the Florida Public Records Statutory definitions and under my Oath as a member of the Florida Bar to act in the best interest of my clients therefore on my clients behalf that I could not in any stretch of the word, legally be an agency of the State of Florida.
Furthermore Sheriff Campbell, the cases you have requested information on although they were appointed to me to represent the client as an attorney by the State of Florida, that relationship has, is and was from the beginning a contractual relationship.
My duties as a Conflict Attorney with the State of Florida is as an independent contractor with the State and an attorney for my clients.
A Writ in Mandamus was filed by my office on July 25, 2008, in an attempt to have your agency to comply with several outstanding public records requests that I have sought solely to aid in the investigation of defenses for my clients and my practice as a defense attorney. There is a hearing scheduled in Circuit Court in Leon County in front of Chief Judge Francis on Monday September 22, 2008. I spoke with Major Alan Griner, your legal advisor, member of the Florida Bar, on the phone yesterday, September 15, 2008 in the early morning as ordered by Judge Francis, in an attempt to resolve outstanding requests etc. Later in the day I emailed your office a chart detailing all requests made and still outstanding etc. It was later last evening (again to be perfectly clear September 16, 2008), I received your records requests via fax.
Clearly, the documents you are requesting would have been submitted to the Justice Administrative Commission, and quite clearly the JAC is an agency as defined under Florida Statute 119.011(2). Despite that being blatantly obvious and quite available to you, you chose to attempt to retrieve records relating to my representation of prior clients from me.
While the Leon County Sheriff's Office is an agency of the State of Florida and falls under the provision of Chapter 119 of the Florida Statutes, I am a private attorney who represents my clients to my fullest potential and then the rest of what is left of me. I am regulated by both the Florida Bar Rule 4.6 and the attorney client privilege once it is asserted.
When I make a request from your agency Sheriff Campbell I have both a right to it and a reason for it under the law.
When you made your request to my privately owned law firm, what were your reasons, harassment, retaliation, stonewalling, or fishing? In any event, I have researched the law and I am of the opinion that there is no statutory provision that requires me to reply to your 119 requests. However, since you sent me the letters, you must know something I do not and would request that you explain to me in writing why you believe that my office is subject to Chapter 119. Once you do, I will continue to research the issue and reply accordingly.
For your information, my hourly rate is $250 per hour and Mr. Harvey is $350 per hour.

On September 21, 2008 at 4:11 p.m. you sent an email from datdivanj01@live.com requesting information regarding a prior public records request and asking questions. Some of the email appears to be a request for public records pursuant to Chapter 119, Florida Statutes.
I have not been available to respond to you and mistakenly believed another individual was responding to your inquiry. When I received an email from you September 30, 2008 at 3:26 p.m., I determined that your questions and new public records request had not been responded to. I apologize for the misunderstanding.
The following is a list of the questions/requests made by you and our response:
1. "Reason why you refused to email the records requested since they are kept electronically."
This was not a refusal and we believe we satisfied the requirements of Chapter 119, Florida Statutes, by providing the documentation in a reasonable time frame.
2. "Explanation as to why I was charged $20.73 for a one page document."
There was a research fee of $20.58 and $ .15 fee for the single page. In actuality, the research fee was undercharged but we are not seeking any additional fees. Further, the document was created as a courtesy. Chapter 119, Florida Statutes does not require the creation of documents. We did, however, create this document for you so that you would have the information you were seeking.
3. "Fee schedule for your office when responding to Public Records Request."
The fee schedule depends on the type of request made and the individuals required to work on making the records available. We comply with the requirements of Florida Statute. We typically send a letter outlining the hourly rates of the individual working on the request, the attorney that will review it, and the estimated number of pages. Attorney review time to determine exemptions from the public record is typically in the range of $50.00 per hour. Computer search time is typically at the rate of $ 38.40 per hour. And we charge $ .15 per page to duplicate the records.
4. "Copy of your most recent retention schedule form."
We are treating this as a new request for records pursuant to Chapter 119, Florida Statutes. A copy is available for the total cost of $ .60. Upon receipt of the $ .60 we will either fax, mail, or provide a copy to your or your designated representative at our office.
5. "Copy of your most recent Records Disposition Document Form."
We are treating this as a new request for records pursuant to Chapter 119, Florida Statutes. There are no documents maintained by this agency responsive to your request.
6. "Record Inventory Worksheet."

I have been asked to respectfully request that your office conduct a thorough and comprehensive investigation into allegations of inappropriate conduct and criminal violations by the State Attorney's Office of the Second Judicial Circuit particularly Chief Assistant State Attorney Jackie Fulford.
The purpose of this request if to determine whether the State Attorney's Office trough its employees and/or records custodian has:
Violated Florida Statutes Chapter 119 or any other Florida Laws.
Violated Florida Administrative Code Rule 1B-24, F.A.C. Public Records Scheduling and Dispositioning.
Violated Florida Administrative Code Rule 1B-26, F.A.C. Records Management Standards and Requirements.
Violated Florida Bar Rules and American Bar Association Standards of Criminal Justice Relating to Prosecution Function.
Unlawfully obstructed another party's access to evidence
Improperly advising witnesses not to speak to opposing parties
Improperly advising Assistant State Attorneys to advise witnesses not speak to opposing parties
Improperly advising law enforcement to refuse opposing parties request for records under Chapter 119.
Intentionally withheld information from other Assistant State Attorneys of the Second Judicial Circuit that may have affected prosecutions in cases being prosecuted.
Intentionally and/or negligently failed to insure office compliance with Florida Rules of Criminal Procedure 3.220.
To confirm whether there is sufficient evidence to pursue criminal charges.
Whether Jackie Fulford and other prosecutors failed in their responsibility of ministers of justice.
The State Attorney's Office is not only obligated under the law to comply with Chapter 119, they are also obligated to create accurate and true records. It is an essential element of our justice system that we at least can expect our public officials to not cover up criminal activities. I am not an investigator or a law enforcement officer and what I think is not law. Therefore, I will leave it up to you to decide whether or not you want to investigate Chief Assistant Attorney Jackie Fulford and the State Attorney's Office for misconduct and/or criminal violations. However, on behalf of many I beg you, to remember that when a prosecutor is permitted to continue to exercise the greatest responsibility of a minister of justice while choosing to ignore the requirements of the law herself, we are all at risk.
There is certain expectation we all have of our local State Attorney's Office and without prosecuting Chapter 119 violations by members of the Florida Bar entrusted with individuals freedom, vital records may never be discovered by the public or destroyed before inspection in violation of the State Constitution.
Consequently, I am asking you to please investigate whether any member of the State Attorney's Office for the Second Judicial Circuit violated any laws including the Florida Constitution and decide whether they are competent to continue to represent the State of Florida.

You are correct, the 28 tapes which you had picked-up on 6/5/08 were in response to your request 2. b) in which you requested the "Internal Affairs investigative records, notes, tapes and/or CDs" for Dep Bradley.
Per the e-mail you Were sent by me on 04/18/08 ~ 10:36 AM; "Per Becky Gay in LCSO Communications due to the age of these transmissions they are no longer available, they met retention and were destroyed."
Cassandra provided you a copy of the retention schedule concerning communication tapes on May 8, 2008 when she saw you in Court. If you need another copy please let us know and we will make another copy. LCSO is unable to provide a spedfic date of destruction; once the mastertapes have met their retention they are placed in the "que" for the tapes to be reused as needed (no paperwork is completed when they are reused/written over).
In response to your question about "still waiting to hear when I can tome inspect the other records previously requested." I assume this is in reference to your request which LCSO received on May 29, 2008. Cassandra spoke with you via phone on May 30th and via e-mail on June 2 requesting the exhibits (they identify the records you are requesting) which your fax referenced but which were not attached. Once we receive this information we will gladly process your request.
Also, in reference to your statement; 'i am not willing to pay more than $30 for anyone request and would like an opportunity to have someone from our office come look trough them before we decide what we would like copied." As you are aware items you request may be exempt from disclosure under 119 for various reasons. Due to the voluminous nature of many of your requests extensive staff time is required to review your requests for exempt information, LCSO charges all requestors. $18.25 per hour for this time. Once this review has been completed by LCSO you are welcome to have someone then come in and review the Records; a LCSO staff member is present during this review, LCSO charges all requestors $18.25 per hour for this time; once the information for which copies are requested is identified, copies will be made and you (or any requestor) are charged .15 per page, $8.00 per cassette tape, etc. (based oh LCSO schedule of charges).
